Terms of service

These terms govern the use of grawGoDev at dev.go.graw.de: the web application in your browser and the iOS and Android apps, which display the same web application.

1. Provider and scope

The service is provided by ("we", "us"):

Graw Radiosondes GmbH & Co. KG
Muggenhofer Str. 95
90429 Nuremberg
Germany
info@graw.de

The service is intended exclusively for public and private organisations and the people who use it on their behalf; it is not offered to consumers for private purposes. If your organisation has concluded a separate contract with us about the service, that contract takes precedence and these terms supplement it. Terms of your own or of your organisation do not apply, even if we do not object to them.

2. The service

grawGoDev is used to manage radiosonde stations and flights: it receives, stores and displays measurement data and positions, shows flights in real time, calculates statistics from them, sends notifications and offers an API. The scope of functions is the one currently available in the service. Fees, availability commitments and support, if any, follow from the contract with your organisation.

3. Accounts

There is no self-registration. Accounts are created by us or by an administrator of your organisation for the people who work with its radiosonde stations. Which stations you can see and change is decided by your role and by the administrators.

Keep your password and any second factor confidential and do not share your account with others. We recommend turning on two-factor authentication or using a passkey. Tell us or your administrator without delay if you suspect that somebody else is using your account. Actions taken with your account are attributed to it.

4. Acceptable use

You may not:

  • use the service in breach of applicable law or the rights of others;
  • access or try to access data, stations or accounts you have not been given access to, or circumvent security measures;
  • upload malware or content that is unlawful;
  • load the service with automated requests beyond what the documented API is meant for, or impair its operation in any other way;
  • decompile or reverse-engineer the software, except where the law expressly permits it.

5. Your data

The stations, flights, measurements, images and attachments that you or your organisation enter remain yours or your organisation's. You grant us the rights needed to store, process, display and transmit them to provide the service, including to the people you share them with. You are responsible for having the rights to what you upload.

A flight's read-only link lets anybody who has it view that flight without signing in. Whoever passes the link on decides who can see the flight; a station administrator can renew the link at any time, which makes the old one stop working.

How we process personal data is described in the privacy policy.

6. Meteorological data

Measurement data and values calculated from it are displayed as received from the radiosonde and ground equipment. They can be incomplete, delayed or wrong, for example because of reception problems. Check them for plausibility before relying on them. The service is not a substitute for official weather warnings or air traffic services; complying with the regulations that apply to launching radiosondes remains your responsibility.

7. Availability and changes to the service

Unless agreed otherwise with your organisation, we do not guarantee any particular availability. The service can be unavailable at times, for example during maintenance or updates. We develop the service further and may change or remove functions, as long as this is reasonable for you, taking your interests into account.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence, we are liable only for breaches of an essential contractual obligation, that is, an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely; this liability is limited to the damage that is foreseeable and typical for this kind of contract. Otherwise, our liability is excluded. These limitations also apply to our employees, representatives and vicarious agents.

9. Suspension and termination

You can stop using the service at any time and ask your administrator or us to delete your account. We may suspend or delete an account that breaches these terms, or block access temporarily where this is necessary to protect the service or other users. Your access ends when the contract between your organisation and us ends, or when your organisation removes it.

10. Changes to these terms

We may change these terms for the future, for example when the service or the law changes. We announce changes in good time in the service. If you do not agree with a change, you can stop using the service.

11. Final provisions

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with the use of the service is Nuremberg, Germany, to the extent permitted by law. Should any provision of these terms be invalid, the validity of the remaining provisions is not affected.
